| DEFINITIONS: In the following Terms and Conditions; the “Hirer” shall be deemed to be the person responsible for chartering the vessel; the “Company” shall be deemed to be City Cruises plc; the “Captain” shall be deemed to be the person appointed by the Company to be in charge of the vessel for the duration of the charter or the person nominated by the Company to take over the role of Captain in the event of the incapacity, for any reason, of the appointed Captain.
HIRE FEE: A non-returnable deposit of 25% of the estimated total cost of the charter is payable on booking. The balance, including costs of catering, music and any other requirements is to be paid no later than 14 days prior to the date of function. If the Hirer cancels within 6 weeks of the date booked he will remain liable for the full costs of the hire, unless the company is able to re-let the vessel for that date.
CONTROL OF THE VESSEL: During the hire, the vessel will remain at all times under the complete control of the Captain. If the Captain considers it necessary to vary the duration, destination or route of the charter due to the actions or behaviour of the hire party or due to weather, tidal or other reasons his orders will be obeyed by the Hirer. In such instance, the Company will not be liable under any circumstances for any expenses incurred by the Hirer as a result of such variation in the charter. If it is necessary to vary the charter due to actions or behaviour of the hire party, the Hirer will be liable for all expenses and any consequential loss caused by such variation.
LIABILITY OF COMPANY: The Company will not be liable for any loss, damage or delay to any persons or their possessions whilst embarking or disembarking from the vessel or at any time during the charter which may arise from or be in any way connected with any act, omission or negligence of any person employed by the Company. The Company will not be liable for death or personal injury to any persons resulting from any act or omission other than the Company’s negligence.
DAMAGE OR LOSS: The Hirer will be liable for any loss or damage to the vessel or equipment or for any delay howsoever caused by them or by persons in their party. The cost of such loss or damage to the vessel or equipment will be charged for at cost price and where appropriate the cost of labour will also be included in such costs. In the event of any loss or damage to the vessel or equipment or for any delay caused by the Hirer or by persons in their party, the Hirer will be liable for all consequential losses of the Company, which may arise. Before embarkation the Hirer is invited to inspect the vessel.
THE VESSEL: The Company reserves the right to substitute the vessel chartered with another vessel and, if necessary, to alter the destination, duration or route of the charter or cancel the Charter for reasons such as, but not limited to, mechanical failure, weather and tidal conditions which are beyond its control. In such instances the Company will not be liable in any event for any expenses or consequential loss incurred by the Hirer or members of the Hirer’s party caused by such substitution, alteration or cancellation.
